Terms of Use

These Terms of Use ("Terms") govern your use of Stardust Recorder ("Stardust," "the app"), an iOS application operated by Astir Technology ("we," "our," "us"), based in Sydney, Australia. By downloading, installing, or using Stardust Recorder, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Stardust Recorder, or the minimum age required to consent to digital services in your jurisdiction (whichever is higher). If you are under 18, you should review these Terms with a parent or guardian.

2. License to Use

Astir Technology grants you a personal, non-exclusive, non-transferable, revocable license to use Stardust Recorder on iOS devices you own or control, subject to these Terms and Apple's App Store Terms.

3. Recording Responsibility

You are solely responsible for ensuring your use of Stardust Recorder complies with applicable laws. Recording laws vary significantly by jurisdiction:

• Some jurisdictions require consent from all parties to a recorded conversation (commonly called "all-party" or "two-party" consent jurisdictions).
• Other jurisdictions require consent from only one party (typically the person making the recording).
• Recording in workplaces, schools, government buildings, or other restricted settings may have additional rules.
• Recording for commercial purposes, journalism, or legal proceedings may have specific requirements.

Before recording others, you must understand and comply with the laws that apply to you. Stardust Recorder displays consent reminders during onboarding and on the recording screen, but these are courtesy notices, not legal advice.

You agree not to use Stardust Recorder for any unlawful purpose, including but not limited to: recording without required consent, harassment, stalking, surveillance of individuals without authorization, or recording in locations where recording is prohibited.

4. Your Content

You retain all rights to the audio recordings, transcripts, summaries, and action items you create with Stardust Recorder. We do not claim any ownership over your content.

Because all your content is stored on your device and never transmitted to our servers, we have no access to it. We cannot retrieve, restore, or recover content if you delete it, lose your device, or experience data corruption.

5. In-App Purchases

Stardust Recorder offers a free tier and a paid tier ("Stardust Pro") with two purchase options:

• Lifetime: A one-time purchase that grants ongoing access to Stardust Pro features for the life of the app on your Apple ID.
• Monthly: An auto-renewing subscription that grants access to Stardust Pro features. The subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel subscriptions through your iOS Settings → Apple ID → Subscriptions.

All purchases are processed by Apple through the App Store and are subject to Apple's Terms and Conditions. Refunds are handled by Apple (support.apple.com/HT204084).

Pricing is set in your local currency by Apple based on your App Store region. Prices may change with notice.

6. Restoration of Purchases

If you reinstall the app or use Stardust Recorder on a new device with the same Apple ID, you can restore previous purchases through Settings → Restore Purchases. We do not maintain separate purchase records on our servers; restoration relies on Apple's records.

7. Free Tier Limits and Trials

The free tier of Stardust Recorder has the following limits:

• Maximum recording length: 30 minutes per recording
• Maximum recordings: 15 recordings per rolling 30-day period (recordings under 30 seconds do not count toward this limit)
• Whisper Base model only (multilingual, with auto-detect across 99+ languages)
• Plain text export only

Some Pro features include 5 free trials each, available to free users without a subscription. These trials are tracked locally on your device and are not refunded between sessions or installations.

8. Acceptable Use

You agree not to:

• Use Stardust Recorder for any unlawful purpose
• Reverse engineer, decompile, or attempt to extract source code from the app
• Modify the app, including removing or altering copyright notices or trademarks
• Use Stardust Recorder to record any individual without legally required consent
• Use Stardust Recorder in violation of any applicable law or regulation
• Attempt to bypass purchase or trial limitations

9. Disclaimers

Stardust Recorder is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

Transcription accuracy depends on factors including audio quality, speaker accents, language, background noise, and Whisper's model capabilities. We do not guarantee accuracy of transcripts, summaries, or action items.

Apple Intelligence features (summaries, action items) require an Apple Intelligence-capable device running a supported iOS version. Availability and quality depend on Apple's underlying systems.

10. Limitation of Liability

To the maximum extent permitted by law, Astir Technology and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Stardust Recorder, including but not limited to:

• Loss of recordings, transcripts, or other data
• Inaccurate transcriptions or summaries
• Failure to comply with applicable recording laws
• Any consequences of recording or sharing content created with the app

Our total liability for any claim relating to Stardust Recorder shall not exceed the amount you paid for the app in the 12 months preceding the claim.

11. Australian Consumer Law

Nothing in these Terms excludes or limits any non-excludable consumer guarantees under the Australian Consumer Law. If you are an Australian consumer, you have rights that cannot be excluded by these Terms.

12. Changes to the App or Terms

We may update Stardust Recorder, change features, or update these Terms. Material changes to these Terms will be communicated through an in-app notice. Continued use of the app after changes constitutes acceptance of the updated Terms.

13. Termination

You may stop using Stardust Recorder at any time by deleting it from your device. We may terminate your access to Stardust Recorder if you materially breach these Terms.

Your purchases (lifetime or active subscription period) are not affected by these Terms; they are managed through Apple.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales, Australia, except where local consumer protection laws require otherwise.
